Last ILS Lunch Seminar before the summer break with Prof. Rank and Prof. Barentsen
The monthly ILS Lunch Seminars present the perfect opportunity to unite the different institutes situated within Leiden Law School and are steadily developing into somewhat of a tradition. On Thursday 14 June, the last edition of the ILS Lunch Seminars of this academic year takes place. This seminar will feature presentations from Pim Rank and Barend Barentsen, two professors from different legal backgrounds at Leiden University.
Prof. Pim Rank is a professor of financial law and a partner at NautaDutilh in Amsterdam. During the next ILS Lunch Seminar, he will give a presentation on: “Custody and Asset Segregation under MiFID II”. Under the new Markets in Financial Instruments Directive (‘MiFID II’), investment firms are obliged to make adequate arrangements so as to safeguard the ownership rights of clients. This condition applies especially in the event of the investment firm’s insolvency. In practice, this means that the securities held by the investment firms for its clients needs to be legally segregated from the investment firm’s own assets. In this presentation, prof. Rank will discuss the rationale behind this requirement and the methods used in legal practice to achieve asset segregation. In addition he will explain how the custody of securities is organized in practice.
The second presentation will be given by Prof. Barend Barentsen, professor of labour law at Leiden Law School. He will give a presentation on “Public sector reform in the Netherlands: much ado about nothing?”. As of January 1st 2020, the legal status of most of the workers in the public sector will change: their public appointment (‘aanstelling’) will be converted into an employment contract (‘arbeidsovereenkomst’). This operation includes workers at Leiden University, which will conclude contracts with their staff starting 2020. Does this change mean anything, and if so: what?
