The Active and the Successful Parties in Preliminary Ruling Procedures
In this lab meeting, Isak Nilsson (PhD student at Umeå University) will present a draft article concerning whether resource-strong parties are more successful in convincing national judges, who act as gatekeepers, to refer questions to the Court of Justice of the European Union, compared to small businesses and individuals.
The focal points of the session will be the question of party imbalances and how empirical methods can be employed to uncover patterns highlighting potential disparities in access to justice.
