Louise Verboeket wins faculty Jongbloed thesis prize 2016-2017
The thesis “De publieke prijs. Een onderzoek naar de verdeling van publiek geld via prijsvragen” (The public prize. A study of the allocation of public funds by way of competitions) was awarded the faculty Jongbloed prize 2016-2017 on 12 January.
Concrete and practical contribution to administrative law
Louise Verboeket’s thesis deals with a topical and socially relevant issue in an exemplary fashion. Facilitating government authorities increasingly, and to the sum of millions of euros, use public awards as a means to stimulate innovation and quality. This system of allocation does not only involve policy makers and administrators, but also academics (NWO) and even students (thesis prizes). Safeguards concerning legitimacy, transparency, equal treatment and complaint procedures are necessary, since the allocation of public funds and semi-public funds is at issue. Or as Verboeket states succinctly: “public funds entail obligations”. But in contrast to customary instruments such as subsidy or tendering procedures, which are surrounded by rules and safeguards, the legal foundation and framework of public competitions is sometimes not clear at all. Actions by government authorities are arbitrary. As a result they not only risk a judicial slap on the wrist, but even proceedings under European law due to illegal state aid. Louise Verboeket has carried out a comprehensive investigation of this largely unexplored area of law. The thesis concludes with clear and useful recommendations. She has written a concrete and practical contribution to administrative law which has already drawn attention from the Netherlands Bureau for Economic Policy Analysis (CPB) and one of the top Dutch law journals.
