Christa Tobler comments on the role of the European Court of Justice in Swiss-EU talks on renewed institutional rules.
Switzerland and the EU are linked by a large number of agreements on many different issues. For some years now, the parties have been looking for common ground on renewed institutional rules for a number of core economic agreements. This includes in particular a new system of dispute settlement for which the EU is pushing for an important role of the Court of Justice of the European Union (CJEU) in arbitration proceedings. In the Swiss public debate, it is often argued that a solution without the CJEU should be found. In her guest contribution in the Swiss daily Neue Zürcher Zeitung, Christa Tobler notes that in Switzerland there is much wishful thinking in this respect that disregards important constitutional elements of Union law.
