About the event
The availability of digital evidence has ushered in a new era of human rights accountability. International courts, like the Special Tribunal for Lebanon and the International Criminal Court, increasingly consider digital evidence to enhance accountability of individuals and states who committed grave human rights violations. Similarly, the Independent International Fact-Finding Missions in Myanmar and the Commission of Inquiry on the Occupied Palestinian Territory, both mandated by the United Nations Human Rights Council, relied on digital material to expose grave human rights violations. In Ukraine, legal experts currently collect digital information on war crimes, in the hope that it will eventually be used as evidence in a trial.
The use of digital evidence will fundamentally change the work of international courts and human rights investigators. On the one hand, digital evidence will potentially make international institutions more efficient and more accessible to citizens and victims. Yet, important questions remain unresolved, for example regarding standards of admissibility, the participation of victims, persistent inequalities in access to the digital realm across the world, the role of biases and the influence of deep fakes. Through this roundtable discussion, we hope to foster a better understanding of the intricacies of the use of digital open source evidence in international (criminal) proceedings.
